Coinbase CEO Brian Armstrong said in an Aug. 20, 2026 interview that he expects the Clarity Act to clear more than 60 votes in a Senate cloture vote scheduled for September 15, a forecast that puts him well ahead of Kalshi traders, who currently price just a 22% chance the bill hits that threshold.

Senate vote puts Clarity Act at a critical crossroads

The Clarity Act is expected to face its most consequential Senate test on September 15, when lawmakers return from recess. The scheduled cloture vote follows the Senate’s decision not to consider the legislation before the August break and comes after pressure from President Donald Trump to advance the measure.

Cloture would not itself enact the Clarity Act. Instead, a successful vote would end debate and overcome a potential filibuster, allowing the Senate to proceed toward a later vote on final passage.

The distinction is important because the same 60-vote threshold is central to both stages. A successful cloture vote would therefore offer a strong indication that the legislation has sufficient bipartisan support to advance.

Armstrong has expressed confidence in that outcome, arguing that Senate Majority Leader John Thune would not have scheduled the vote without believing the bill had a realistic path forward “has a great chance of passing” — Brian Armstrong, Coinbase CEO.

The numbers behind the Clarity Act vote

The Senate’s current composition creates a demanding mathematical hurdle for the Clarity Act. Republicans control 53 seats, meaning at least seven Democrats would need to join Republicans for the measure to reach the 60-vote cloture threshold.

That arithmetic is central to the disagreement between Armstrong and prediction-market participants. While the Coinbase chief expects the legislation to surpass 60 votes, Kalshi traders currently place the probability of that happening at just 22%.

The gap highlights the political uncertainty surrounding the bill. For Armstrong’s forecast to materialize, Democrats would need to provide enough support despite several outstanding concerns surrounding the legislation.

Democratic lawmakers have been reluctant to endorse the measure without additional ethics provisions concerning politicians’ investments in cryptocurrency-related businesses. Those concerns have gained particular attention following President Trump’s reported cryptocurrency profits last year.

Banking groups have also questioned whether the bill’s stablecoin provisions provide sufficient protection for traditional financial institutions. The legislation would prevent idle stablecoins from generating yield, although it would permit rewards associated with certain activities, including transactions.

What the Clarity Act would change

Beyond the immediate Senate vote, the Clarity Act is designed to establish a broader regulatory framework for the cryptocurrency industry and clarify which federal agencies have authority over different parts of the market.

One of its key provisions would give the Commodity Futures Trading Commission exclusive jurisdiction over spot markets for digital commodities. The Securities and Exchange Commission and the CFTC have, at various times, asserted jurisdiction over portions of the cryptocurrency market, contributing to uncertainty for digital-asset businesses.

The proposed framework is therefore being closely watched by cryptocurrency companies and financial institutions seeking clearer rules governing digital assets.

For supporters, passage of the Clarity Act could provide greater certainty over regulatory responsibilities and reduce disputes about federal oversight. For critics, however, unresolved questions involving ethics, stablecoins and the balance between traditional financial institutions and digital-asset firms remain significant obstacles.

September 15 could determine the Clarity Act’s momentum

The September 15 cloture vote could become the clearest indication yet of whether the Clarity Act has enough bipartisan support to advance before the Senate’s next major scheduling constraints.

If at least 60 senators support cloture, debate would end and the legislation could proceed toward a formal vote. That result would not constitute final passage, but it would signal that the bill has overcome one of its most significant procedural barriers.

If cloture fails, the legislative timetable could become considerably tighter. The Senate is scheduled to break again in early October for the midterm elections, leaving lawmakers with limited time to revive the measure before that pause.

That timing makes the Clarity Act vote particularly significant. A failure to reach 60 votes could leave the legislation’s future uncertain, while a successful vote could strengthen expectations that it will eventually reach final passage.

Armstrong has also indicated that he remains supportive of regulators’ efforts even if Congress does not approve the legislation.

The contrast between Armstrong’s confidence and Kalshi’s 22% probability will remain a central feature of the debate ahead of the vote. Ultimately, the Clarity Act will depend not on prediction-market expectations but on whether its supporters can secure the seven or more Democratic votes needed to reach the Senate’s 60-vote threshold.

For the Clarity Act, September 15 therefore represents more than a procedural vote: it is a test of whether bipartisan support for comprehensive cryptocurrency market regulation can translate into enough votes to move the legislation toward final passage.
