Crypto kiosk operators in Illinois have refunded $750,206.61 to customers who reported being scammed, the Pritzker administration said Monday. More than 450 people have asked for their money back since August 2025 under the state’s Digital Asset Kiosks Act, which caps fees at 18% and limits new customers to $2,500 a day.

Digital Asset Kiosks Act delivers consumer refunds

The refunds represent one of the clearest early indicators of how Illinois’ cryptocurrency regulations are being applied to consumer complaints. Under the Digital Asset Kiosks Act, digital asset kiosk operators must comply with requirements designed to improve transparency and establish safeguards for customers using their services.

The law was introduced in response to concerns about fraud involving cryptocurrency kiosks, which allow customers to exchange cash for digital assets. Such transactions can be exploited by scammers who persuade victims to deposit money into cryptocurrency machines and transfer the resulting digital assets to wallets controlled by criminals.

Illinois officials say the refund figures demonstrate that regulatory protections can provide a practical remedy for consumers who experience financial losses.

“Illinois has put stronger consumer protections in place, and we’re seeing results,” said Sen. Laura Ellman, a Democrat from Naperville.

“People are getting money back, and operators are being held accountable. We will not let scams go unanswered,” Ellman added.

Her remarks underscore the law’s central objective: making cryptocurrency kiosk operators more accountable while giving consumers a clearer process for seeking compensation after fraudulent transactions.

Although the reported refunds indicate that some customers have recovered money, the figures do not establish the total value of cryptocurrency fraud involving Illinois residents. They also do not show how many refund requests remain unresolved or how much money consumers may have lost beyond the amounts returned.

Digital Asset Kiosks Act introduces transaction limits and fee caps

Beyond the refund process, the Digital Asset Kiosks Act establishes restrictions intended to reduce the financial risks associated with cryptocurrency kiosk transactions.

One of its key provisions caps transaction fees at 18%. The legislation also limits daily transactions for new customers to $2,500, a measure intended to reduce the amount inexperienced users can transfer through the machines in a single day.

The law further requires operators to report kiosk locations and comply with consumer protection obligations aimed at addressing fraudulent activity.

These provisions are particularly relevant because cryptocurrency transactions can be difficult to reverse once digital assets have been transferred to another wallet. Unlike conventional payment arrangements, a completed blockchain transaction generally cannot simply be cancelled by a bank or payment provider.

By placing limits on fees and transaction amounts, Illinois lawmakers sought to introduce additional safeguards for customers who may not fully understand the risks of digital asset kiosks.

The requirements also create greater accountability for businesses operating cryptocurrency machines within the state. Location reporting can help regulators identify the businesses responsible for operating kiosks, while the refund procedures provide a defined route for eligible customers to report fraud and seek financial relief.

However, recovering funds depends on victims meeting the law’s reporting requirements. Consumers who believe they have been scammed must notify the kiosk operator within 30 days of the transaction and provide a police report to the operator within 60 days.

These deadlines make prompt action important for anyone seeking a refund under the state’s framework.

Digital Asset Kiosks Act faces industry opposition

Despite the reported refunds, the legislation has faced opposition from some Republican lawmakers and industry participants who questioned the need for state-level restrictions.

Republicans argued that Illinois should consider following regulatory approaches adopted by other states rather than introducing its own requirements for cryptocurrency kiosk operators.

During discussions surrounding the legislation, Sen. Steve McClure, a Republican from Springfield, raised questions about Coinbase’s position on the bill.

“Coinbase is, as far as I know, still in opposition to this bill,” McClure said.

He continued: “As far as this moment, are they the only opponent, and are they still opposed?”

Democrats countered that Coinbase’s opposition reflected broader resistance to state-level cryptocurrency regulation. They also described the company as a responsible participant in the cryptocurrency industry while maintaining that regulatory requirements were necessary to protect consumers.

The disagreement reflects a wider policy debate over how governments should regulate digital asset businesses. Supporters argue that clear rules can help prevent fraud and establish accountability, while critics may question whether state-specific requirements create additional compliance burdens for companies operating across multiple jurisdictions.

The Digital Asset Kiosks Act places Illinois among the jurisdictions seeking to address cryptocurrency kiosk risks through explicit consumer safeguards. Its reported refund totals provide an early measure of the law’s implementation, although further information would be needed to assess its broader effect on fraud rates, consumer losses and industry compliance.

Digital Asset Kiosks Act gives consumers a route to report fraud

Illinois residents who suspect they have been victimized through a cryptocurrency kiosk can pursue a refund by following the deadlines established under the law. They must report the suspected fraud to the operator within 30 days of the transaction and submit a police report within 60 days.

Consumers are also encouraged to notify the Illinois Department of Financial and Professional Regulation (IDFPR), the state agency responsible for overseeing relevant financial services and regulatory compliance.

Complaints can be submitted through the IDFPR’s official complaint portal. Additional information about cryptocurrency and Illinois regulations is available on the department’s digital assets information page.

The department says the refund figures demonstrate the practical importance of consumer protection measures in a rapidly evolving financial sector.

“When we put meaningful protections in place, we expect those protections to make a difference in the lives of Illinoisans,” said Mario Treto Jr., secretary of the IDFPR.

“More than $750,000 returned to consumers is a clear indication that the Digital Asset Kiosks Act is doing exactly what it was intended to do. IDFPR will continue its efforts to demonstrate that innovation and consumer protection can, and should, go hand in hand,” Treto added.

The administration’s announcement suggests that the Digital Asset Kiosks Act has already provided a financial recovery mechanism for some Illinois consumers. Nevertheless, the number of refund requests alone does not establish how effectively the law has reduced cryptocurrency fraud or whether all eligible victims have received compensation.

For consumers, the immediate priority remains recognizing suspicious transactions, reporting suspected scams quickly and retaining the documentation required to support a claim.

As cryptocurrency adoption continues to evolve, Illinois’ experience highlights the challenge facing regulators: creating safeguards that protect consumers without unnecessarily restricting legitimate digital asset activity. The state’s next test will be whether the refund process and other requirements continue to deliver meaningful protection as regulators gather more evidence about the law’s longer-term effects.
